Judicial Enforcement Limited in Alabama Coalition for Equity Litigation

Following the 1993 school-funding ruling, the Alabama Supreme Court declined in Ex parte James in 1997 to require a specific legislative response. In 2002, the Court dismissed the litigation, holding that education policy decisions were within the authority of the Legislature and were not subject to further judicial enforcement.

Following Roosevelt v. Bishop, the Arizona Legislature enacted the Students FIRST Act of 1998, establishing a state-managed system for public school facility funding and oversight and establishing the Minimum School Facility Adequacy Guidelines as the baseline for state-supported school construction, renovation, and repairs.
