1993 School Funding System Constitutional Holding

In the Alabama Coalition for Equity litigation, the Montgomery County Circuit Court held in 1993 that Alabama's public school funding system violated the Alabama Constitution and ordered development of a remedy. Judicial Enforcement Limited in Alabama Coalition for Equity Litigation

Following the 1993 school-funding ruling, the Alabama Supreme Court declined in Ex parte James in 1997 to require a specific legislative response. In 2002, the Court dismissed the litigation, holding that education policy decisions were within the authority of the Legislature and were not subject to further judicial enforcement.
